SACRAMENTO – Planned Parenthood Affiliates of California issued the following statement from President/CEO Jodi Hicks on the U.S. Supreme Court decision issued today in Idaho v. United States and Moyle, et al. v. United States cases. The Court today dismissed the state’s appeal, reinstating the lower court’s order that prevents Idaho from enforcing its ban in cases that conflict with the federal Emergency Medical Treatment and Active Labor Act (EMTALA) while the case continues in the lower courts. 

“In California and across the U.S., EMTALA remains the predominant law of the land for now, but the Court squandered the opportunity to state unequivocally that federal law protects the right to an abortion in emergencies in every state. Let’s be clear: it is absurd that whether pregnant people can get the care they need in emergency situations is even up for debate in the first place. This case proves incontrovertibly that anti-abortion politicians will not stop until they fulfill their anti-abortion agenda– including endangering pregnant people in emergency situations and risking their lives. 

And while abortion opponents did not prevail today, we know they will continue to exploit the legal system and exhaust every avenue to achieve their goal of a national abortion ban. As Justice Jackson laid out in her separate opinion: “[t]oday’s decision is not a victory for pregnant patients in Idaho. It is delay. While [the] Court dawdles and the country waits, pregnant people experiencing emergency medical conditions remain in a precarious position, as their doctors are kept in the dark about what the law requires.”

Make no mistake: these extremists’ cruelty is their point. We cannot let our guard down. Planned Parenthood in California will continue to fight for patients and their full reproductive freedom so every person can access the care they need, when they need it, no matter what.”
